Rakoff ‘ made a mistake of law ‘ in Citigroup’s decision, Khuzami Says

Robert Khuzami, Director of the SEC’s Enforcement Division, announced Thursday afternoon the Agency has asked the United States Court of appeals for the second circuit to review the refusal of U.s. district judge Jed Rakoff’s agency’s proposed $ 285 million settlement with Citigroup up mortgage-bond deal.

Last month, a federal district court refused to approve the consent judgment since, in view of that, the underlying allegations unsupported by any facts proved or admitted that as a result, the Court rejected the $ 285 million settlement between the SEC and Citigroup are fairly reflected relief may have been obtained if the SEC win in court.

We believe the law of the court committed error by announcing new and unprecedented standards that inadvertently harm investors by depriving them of, certain and immediate benefits. for this reason, today we filed papers seeking a review of the decision in the United States Court of appeals for the second circuit.

New standard court’s contrary to decades of court decisions that have enforced a similar settlement by federal agencies and State in the country. in fact, the Court routinely has approved the settlement in which the defendant does not admit or even expressly disclaims obligation, just because of the benefits that provide settlement.
